Supreme Court decision on abrogation of Article 370

RSD-New Delhi news:  The Supreme Court has issued a sensational decision on the abrogation of Article 370. Five Judges are reading their opinion on the Centre’s decision. Three of the five judges dissented. It has made it clear that the Center cannot interfere in the decision on Article 370. Chief Justice Chandrachud is reading the verdict. It said that there was no special status when Kashmir was annexed to India. It explained that Kashmir has no separate sovereignty. It concluded that there is no special difference between Jammu and Kashmir and other states. The central government has upheld the decision.

The National Conference (NC), People’s Democratic Party (PDP) and People’s Alliance for Gupkar Declaration (PAGD) moved the Supreme Court against the Centre’s decision. But the verdict was not in their favor. Since the Supreme Court verdict is final, someone has to defend it. Therefore, the BJP had earlier requested that everyone should respect the verdict no matter how it came. National Conference leader Omar Abdullah earlier said that even if the verdict is not in their favour, there is no need to call for agitations. If they have objection, they will fight legally.

While some in Kashmir opposed the Centre’s decision, some supported it. Some objected that the Center had taken away their freedom. Therefore, today’s judgment has become crucial. This verdict has tightened security in Jammu and Kashmir to prevent any untoward incident. Moreover some leaders were detained. Some others were placed under house arrest. Due to the danger of violence, the police who went to the Kashmir Valley in large numbers 2 weeks ago are keeping 10 districts under their control. He warned that action will be taken if anyone provokes people.

On August 5, 2019, the Center abrogated Article 370, which granted special status to Jammu and Kashmir. The state was divided into two Union Territories of Jammu and Kashmir. Thus, the center got the administrative powers over them. Thus, the Center felt that they should bring the whole under their control and completely suppress the terrorist activities there. It is expected that this will put a brake on border incursions and check the conspiracies of China and Pakistan. As the local parties went to the Supreme Court, a five-member bench headed by Chief Justice DY Chandrachud heard the matter from August 2, 2023. It reserved judgment on September 5th 2023. Justice Sanjay Kishan Kaul, Justice Sanjeev Khanna, Justice BR Gavai and Justice Suryakant are members of this bench.
